Welcome to Pouch Health! By using our app, you agree to these Terms of Use, which outline the rules and guidelines for accessing and enjoying our services. We recommend reading this document carefully, but here’s a quick summary of the key points:

1. What These Terms Cover

1.1. Corporate Relationship Pouch Health and London Pregnancy Clinic ("LPC") are trading names under the same parent company. Although Pouch Health offers digital pregnancy tools and LPC provides clinical services such as consultations and antenatal classes, both operate under a unified corporate structure. This means certain services and communications may be branded as either Pouch Health or LPC, depending on their nature, but fall under the same legal entity for purposes of service delivery and liability.  

1.2. These Terms and Conditions ("T&Cs") govern your access to and use of the Pouch Health app (the "App") and its services. They are legally binding between you and Pouch Health. By using the App, you agree to be bound by these T&Cs. If you do not agree, please discontinue using the App immediately.

These T&Cs include:

  • The terms for using the services provided within the Pouch Health App;
  • What you can expect from us, and what we require from you;
  • Your responsibilities when using the App, including how to engage in the community forums and use the Digital Pouch (Digital Wallet);
  • Important disclaimers and limitations of our liability;
  • Details on booking antenatal classes and healthcare services provided through the LPC.

We will communicate with you through the App, via email, or by phone. Depending on the services you engage with, you may receive communications from either Pouch Health or London Pregnancy Clinic. Since both brands operate under the same parent company, these communications are part of a unified system aimed at providing you with a seamless pregnancy journey. For example, you may receive notifications about antenatal class bookings from LPC and reminders about baby growth tracking from Pouch Health.

3. Our Services

3.1. Disclaimer for Services:

Our Digital Healthcare Services are for informational purposes only. They are not intended to provide a diagnosis, medical advice, or treatment. Always consult your healthcare provider for specific medical advice, particularly when making decisions about your health.

  • Not a Replacement for Professional Care: The Digital Pouch and related features do not replace consultations with healthcare providers. In case of any health-related concerns, always consult your healthcare professional or maternity care provider. You can book an appointment with our partner clinic LPC if you’d like

3.2. Pouch Health Services:  

(a) Digital Pouch (Digital Wallet)

  • The Digital Pouch allows users to upload, store, and organise their pregnancy-related reports, images, and videos (these can come from NHS or another private provider). This includes medical records, ultrasound images, and other personal documentation (like reflection on how the your appointments have gone or tracking your state of mind/body).
  • User Responsibility: You are solely responsible for uploading and managing your reports, videos, and images. The Pouch Health app does not automatically sync with any healthcare provider.
  • Access Control: Pouch Health does not have access to your Digital Pouch unless you explicitly invite us to view specific files. If you share access, Pouch Health reserves the right to decline access if deemed necessary.
  • Security: All data is securely stored using AWS Cloud Services. For more details on how we protect your data, please see our Privacy Policy.

(b) Community Forums and Feed

  • Pouch Health provides community forums and a user feed where members can share experiences, post updates, and interact with one another. This includes posts about pregnancy progress, helpful tips, and personal stories.
  • User Conduct: By using these forums, you agree to follow our Community Guidelines, which prohibit abusive language, sharing specific medical advice, and engaging in commercial activities.
  • Reporting Issues: You can use the “Report” button if you encounter content that violates these guidelines.

(c) Antenatal Classes and Community Events

Pouch Health offers access to a variety of antenatal programs and community events, delivered by our partners at the LPC:

  • Antenatal Classes: These classes provide preparation for birth, postnatal care, and overall pregnancy wellness.
  • Community Events: In addition to classes, the community aspect of the App allows users to join events, share experiences, and connect with other expectant mothers through forums and live events.

Booking System: Bookings are managed via the LPC’s integrated system within the App.

Medical Disclaimer: All information provided through the App (including class materials and health articles) is verified by medical professionals, but it does not replace personal consultations with a healthcare provider. Always consult a licensed healthcare professional if you have specific medical concerns.

(d) Clinical Services

Through the App, you can access to book video and audio consultations provided by London Pregnancy Clinic, which operates under the same parent company as Pouch Health. Although branded separately, clinical services such as obstetric consultations, midwifery, and antenatal classes are provided under the LPC brand but are part of the same legal framework as Pouch Health. These services include:

  • Obstetric consultations (online and in-person)
  • Private midwifery consultations
  • Genetic counselling
  • Gynaecological services
  • Mental health counselling
  • Phlebotomy services

The LPC employs internationally recognised experts in fetal medicine and obstetric ultrasound, alongside specialists trained in women’s reproductive health. Consultations can take place in person at their London HQ located at 36 Spital Square, E1 6DY, London, UK, or online.

  • Diagnosis, Recommendations, and Referrals: Practitioners may provide you with a diagnosis, recommendation, or treatment plan during these consultations. They may also prescribe medications or refer you to other specialists as necessary.
  • Emergency Situations: In the event of an emergency, you should not rely on the App. If you are experiencing a pregnancy-related emergency, please contact your Maternity Triage or call 999 immediately. For non-pregnancy-related emergencies, visit your nearest Accident and Emergency Department.
  • While Pouch Health offers digital tools for pregnancy tracking and records management, any medical services, advice, or clinical consultations you receive via LPC fall under their specific Terms and Conditions.  

(e) Pouch Digital Health Features

  • Pregnancy Journey Checklist: A personalised tool that generates a checklist based on your pregnancy data. The tool will help guide you through your pregnancy milestones and provide information on the next steps based on your input.
  • Mood/Body Tracking: Users can manually input health data (including weight change, symptom tracking and mood tracking) to track pregnancy progress. The Digital Pouch helps users manage and view their health records in one place.
  • Pouch Discover: Offers general educational content based on health data/pregnancy progress you provide. You can manually enter or change these health details for a more comprehensive and personalised experience.

4. Medical Disclaimer and Limitation of Liability

The Pouch Health app provides tools and resources to support your pregnancy journey, but it is not a substitute for professional medical diagnosis, treatment, or advice. You should never rely on the App as a replacement for consultations with qualified healthcare providers.

4.1. Informational Purposes Only

The content, tools, and community advice available on the App are for informational purposes only. Always consult your healthcare provider for any concerns related to your pregnancy or general health.

4.2. In Case of Emergency

The Pouch Health app is not intended for use in emergency situations. If you experience a medical emergency, please call 999, contact your Maternity Triage or visit your nearest Accident and Emergency (A&E) department immediately. For non-emergency concerns, contact NHS 111.

4.3. Limitation of Liability

Limitation of Liability While Pouch Health and LPC operate under the same parent company, specific services like clinical consultations and antenatal classes are delivered under the LPC brand. Pouch Health is responsible for maintaining the digital tools (e.g., Digital Pouch, Baby Growth Tracker), while LPC is accountable for medical consultations. Both brands share overarching responsibility for your experience within the ecosystem, but liability for medical issues specifically rests with LPC as the clinical provider.

  • Machine-Learning Translations: Pouch Health is not liable for any inaccuracies or misunderstandings caused by automated translations. For important medical or legal matters, always rely on professional translations.
  • Third-Party Services: If you book services or consultations through the LPC via the App, your agreement is with the Clinic, not Pouch Health. We do not assume responsibility for the services provided by third-party clinics or partners.

4.4. Disclaimer of Warranties

The Pouch Health app and its services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not guarantee the accuracy, reliability, or availability of the App and its services.

Pouch Health will not be held liable for any indirect, incidental, or consequential damages resulting from your use of the App, including but not limited to loss of data, financial losses, or personal injury.

4.5. Medical Advice Disclaimer

Never disregard professional medical advice or delay seeking it because of information you’ve read on the App. If you have concerns about your health or notice changes in your condition, consult your healthcare provider.

Pouch Health is not responsible for errors, omissions, or unintended inaccuracies in the information provided within the App, nor for any violations of ethical or moral standards relating to health and sexual education materials.

5. What We Need from You

To provide the best experience and accurate services through Pouch Health, we require you to provide complete and up-to-date personal information. This includes, but is not limited to, your health data, due date, and any medical reports you choose to upload to the Digital Pouch.

5.1. Accuracy of Information

Accuracy of Information and Data Sharing You are responsible for ensuring that all information you provide is accurate and current. The information you provide, including health data and personal details, may be shared between Pouch Health and LPC as necessary to provide comprehensive services. This data sharing is conducted under the same corporate umbrella, ensuring privacy and security across both brands. For more details, see our Privacy Policy.

  • Health and Personal Details: Be sure to provide correct health information, including pregnancy details and medical history, where applicable.
  • Updates: If any of your information changes (such as your due date or contact details), please update it in the App to keep your profile current.

5.2. One Account Only

Each user is permitted to create one account. Duplicate accounts are prohibited, as they may disrupt our ability to deliver accurate and personalised services. If duplicate accounts are identified, Pouch Health reserves the right to suspend or terminate access to the App.

6. User Conduct and Responsibilities

When using the Pouch Health app, you agree to the following user responsibilities:

(a) Account Security

  • You are responsible for maintaining the confidentiality of your account credentials (username, password, etc.). You must not share your login details with others or allow anyone else to access your account.
  • Password Security: It is your responsibility to ensure that your password is secure and unique to prevent unauthorized access to your account. Pouch Health is not liable for any losses resulting from unauthorized access due to your failure to maintain password security.

(b) Acceptable Use

  • You agree to use the Pouch Health app for personal, non-commercial purposes. You may not use the App to:
  • Conduct commercial activities, including promoting or selling products or services;
  • Reverse engineer, disassemble, or otherwise attempt to derive the source code of the App;
  • Compromise or attempt to compromise the security of the App, including introducing viruses or other harmful material;
  • Violate the Community Guidelines by engaging in abusive, disruptive, or illegal activities within the community forums.
  • Fraud Prevention: You may be required to verify your identity when booking classes or consultations to prevent fraudulent use of the App. Pouch Health reserves the right to suspend or terminate accounts that are found to be fraudulent or misused.

(c) Abusive Behaviour Towards Staff

  • Pouch Health maintains a zero-tolerance policy for abusive, aggressive, or offensive behavior directed towards staff, moderators, or medical professionals.
  • If you engage in such behaviour, Pouch Health reserves the right to suspend or terminate your account, restrict communication methods, or take legal action if necessary.

7. Prices, Booking, and Payment

Certain services available through the Pouch Health app, including consultations and antenatal classes via the LPC, are subject to fees. All bookings, payments, and cancellations are governed by the LPC’s terms of use.

7.1. Booking System

Bookings for healthcare consultations and antenatal classes are facilitated through the LPC’s online booking system, powered by SimplyBook. To secure an appointment:

  1. Select your preferred service (e.g., scan or consultation).
  1. Choose an available date and time.
  1. Enter your contact details and agree to the clinic's terms.
  1. Make a prepayment to confirm your booking.
  1. A confirmation email will be sent automatically with your appointment details.

Pouch Health and LPC share a unified approach to data privacy. Any personal or health-related data you provide via the Pouch Health app may also be accessible to London Pregnancy Clinic when relevant, particularly if you use LPC services such as consultations or antenatal classes. Both brands adhere to the same privacy standards, ensuring that your data is protected and used solely for the purpose of providing comprehensive care.

7.2. Prices

The cost of services at the LPC varies based on the type of appointment or consultation. Note that prices are subject to change.

Additional fees, such as surcharges for weekend or evening appointments, may apply. These fees will be communicated at the time of booking, in accordance with the LPC’s policies.

If you are unsure about the appropriate service or cost, we recommend contacting the clinic directly for advice.

7.3. Payment Methods

You can securely pay for services via the App using the following payment methods:

  • Credit or Debit Cards: Payments are processed through Square and Stripe, ensuring secure online transactions.
  • Pre-authorisation: Both Square and Stripe MAY perform a pre-authorisation on your card to verify payment details.
  • Additional Fees: You may be asked to pay additional charges when attending in-person appointments at the LPC premises, such as surcharges for weekend/evening appointments. These fees will be clearly outlined at the time of booking and are driven by the clinic’s policies.

Both Square and Stripe use SSL encryption to protect your payment information, and neither the clinic nor Pouch Health stores your card details.

8. Cancelling Your Subscription or Booking and Refunds

8.1. Midwife and Obstetrician Subscriptions

Subscriptions for midwifery and obstetrician services through the Pouch Health app are managed by the LPC (LPC). These subscriptions may include ongoing care, consultations, or antenatal services.

If you need to cancel your subscription or alter your bookings, please be aware that these changes will follow LPC's terms and conditions. Subscriptions are subject to their cancellation policies, including possible refunds or fees. For more details, please refer to the LPC’s terms of use.

8.2. Antenatal Classes

If you need to cancel or reschedule an antenatal class, the following terms apply:

  • Cancellations made more than 48 hours before the scheduled class are eligible for a full refund.
  • Cancellations made within 48 hours of the class are non-refundable.

8.3. Consultations and Scans

For consultations, scans, or any healthcare service booked through the LPC, the specific cancellation and refund policies set by LPC will apply. These policies may include charges for last-minute cancellations or rescheduling. For more information, please refer to LPC’s terms and conditions or contact the clinic directly through the app.

8.4. Refunds

Refunds for cancellations or rescheduled appointments, including subscriptions, are processed by LPC through Square or Stripe:

  • Refunds are generally initiated within 3 working days of the cancellation.
  • It may take 5-10 working days for the refunded amount to appear in your account, depending on your bank’s processing time.

9. Limited License to the App

9.1. Personal, Non-Commercial License

We grant you a personal, worldwide, revocable, non-transferable, and non-exclusive license to access and use the Pouch Health app for personal, non-commercial purposes. This license is granted under the terms of this Agreement.

You may not:

  • Copy, store, modify, distribute, transmit, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content obtained from the App without prior written permission from Pouch Health.
  • Use any text, graphics, logos, images, software, or code from the App in any publications, public performances, or websites not associated with the App, or for any commercial purposes.
  • Use content in any manner that could cause confusion among users, discredit or disparage Pouch Health, or infringe on our intellectual property rights or those of our licensors.

Any misuse of the content provided by Pouch Health or third-party content that appears in the App is strictly prohibited.

9.2. Ownership Rights

All rights, title, and interest in and to the Pouch Health app not expressly granted in this Agreement are reserved by Pouch Health. If you wish to use our trademarks, service marks, logos, or any content owned by Pouch Health, you must obtain prior written permission. Requests can be sent to [Insert Support Email].

9.3. Company’s Content

Pouch Health owns all content created and made available within the App, including but not limited to:

  • Text, images, photos, audio, video, location data, software, code, and all other forms of data or communication.
  • Visual interfaces, interactive features, graphics, design, and user content compilations.

This content (referred to as the “Company’s Content”) is owned by Pouch Health and may not be used without permission. We do not grant you any express or implied rights to the App or its content except as explicitly stated in this Agreement.

10. License to User Content

10.1. Ownership of User Content

The Pouch Health app allows you to input personal notes, share stories, post content, and log information about your pregnancy journey (“User Content”). You retain full rights to any User Content you post, share, or log in the App.

By providing your User Content, you grant Pouch Health a non-exclusive, worldwide, royalty-free license to:

  • Use, copy, modify, publicly display, perform, create derivative works from, and distribute your User Content in connection with operating and promoting the App and related services.
  • This license includes the right to display your User Content on our website, within the App, in social media, or other platforms, subject to the Privacy Policy.

10.2. Removal of User Content

Pouch Health reserves the right to review and remove any User Content at its sole discretion, without prior notice. This may occur for any reason, including content that violates our Community Guidelines or is deemed inappropriate for the App.

10.3. Indemnification

You agree to indemnify Pouch Health, its affiliates, directors, officers, and employees, and hold them harmless from any claims, expenses, or damages (including legal fees) resulting from your User Content or any breach of these terms.

11. Use at Your Own Risk

11.1. No Guarantees for Health Outcomes

While Pouch Health aims to provide helpful and informative health-related tools and content to support your pregnancy journey, we do not guarantee specific health improvements or outcomes from using the App.

11.2. Assumption of Risk

Your use of the Pouch Health app and the information, predictions, or suggestions provided within the App is at your sole risk. The information provided is for general informational purposes and is not a substitute for professional medical advice, diagnosis, or treatment.

We make no representations or warranties regarding the accuracy of data, estimates, or predictions provided by the App. You understand and agree that the App is not designed to replace medical devices, healthcare professionals, or scientific instruments in any capacity.

12. What You Can't Do with Our Services

12.1. When using the Pouch Health app and services, you must not:

  • Use the services for commercial purposes, such as promoting or profiting from them on your own website.
  • Engage in any improper, unlawful, or illegitimate activities, including reverse engineering, tampering with, or hacking the app, website, or systems.
  • Damage, disable, or impair the operation or security of the App by introducing viruses, malware, or harmful material, or by using the App in ways not intended.
  • Use the services in a way that is excessive or beyond the normal scope of personal pregnancy tracking, as outlined in our policies.
  • Attempt to gain unauthorised access to user accounts, data (including patient data), or computer systems through any method.
  • Seek free medical advice or consultations from our partner, the LPC (LPC), without being an official patient. You are required to sign a consent form with the LPC before sharing any information with their practitioners.
  • LPC practitioners will not respond to inquiries or provide medical advice unless you have booked a consultation through the App and have completed the necessary consent process.

If you violate these terms, Pouch Health reserves the right to suspend or cancel your account and services without a refund for any paid services or fees.

13. Age Restrictions

13.1. Users must be 18 years or older to use the Pouch Health app. The App is not intended for use by individuals under the age of 18.

14. If Something Goes Wrong

14.1. If you experience any issues while using Pouch Health, please contact us as soon as possible. We will do our best to resolve the issue.

While we aim to provide the services as described, we make no additional warranties or guarantees beyond those stated in these terms.

If we breach these terms, our liability is limited to foreseeable losses at the time these terms were agreed upon. Pouch Health is not responsible for:

  • Losses resulting from failure to follow instructions on how to use the services or improper use of the app.
  • Business losses, as our services are for personal use only.
  • Losses resulting from your breach of these terms or our Privacy Policy.
  • Losses arising from third-party websites or services we link to through the app.

Our maximum liability will not exceed the total amount you have paid us.

14.2. We cannot guarantee uninterrupted access to the services and are not liable for service disruptions beyond our control. However, we will make every reasonable effort to restore access as soon as possible.

15. How to Make a Complaint

15.1. If you have a complaint about the Pouch Health app, please contact us directly via email or through the feedback form.

  • For complaints related to LPC services, the clinic follows a three-stage complaints process in line with the guidelines of the Independent Sector Complaints Adjudication Service (ISCAS). You can read more about their complaints procedure on the ISCAS website here. LPC’s complaints procedure addresses any issues related to consultations, classes, and other services provided by the clinic.
  • If your complaint is about Pouch Health services or the app itself, you can file a complaint by emailing us or submitting a feedback form.
  • For data protection or privacy-related complaints, you can contact the Information Commissioner's Office (ICO). Use the form available on the ICO website, or send your complaint and correspondence to casework@ico.org.uk.

We aim to address all complaints in a timely and respectful manner, working to resolve the issue to your satisfaction.

16. Changes to These Terms

16.1. The Terms and Conditions are available at all times within the Pouch Health app and on our website. We may update these terms periodically to reflect changes in our services, user needs, or legal requirements.

  • If any changes impact your rights or obligations, we will notify you through the App or via email.
  • If you do not agree with the updated terms, you may cancel your subscription or discontinue using the app at any time.
  • By continuing to use Pouch Health after these updates, you acknowledge and accept the new terms.

17. Other Things You Should Know

17.1. Our Company Details

These Terms and Conditions represent an agreement between you and Ultrasound Link Ltd (trading as Pouch Health, LPC, and Spital Clinic).

17.2. Laws and Regulations

Our clinical services, including video and audio consultations, are regulated by the Care Quality Commission (CQC). Additionally, any medical devices, such as those associated with symptom tracking or health data, are regulated by the Medicines and Healthcare products Regulatory Agency (MHRA).

All services offered by Ultrasound Link Ltd, whether under the LPC, Spital Clinic, or Pouch Health brand, adhere to UK laws and healthcare regulations.

If you are using our services outside the UK, you are responsible for ensuring that it is legal to use them in your location. We cannot guarantee that our services comply with the healthcare laws or regulations of other countries.

17.3. Enforcement of These Terms

These terms are an agreement between you and Ultrasound Link Ltd. They apply only to you and cannot be transferred to or enforced by others. Only you can take legal action based on this agreement, unless you are a parent or guardian acting on behalf of a minor.

17.4. Legal Jurisdiction

These terms are governed by the laws of England and Wales. If you wish to take legal action related to these terms, it must be through the courts of England and Wales.

18. Use of Mobile Devices

18.1. When using the Pouch Health app on a mobile device, please be aware that your mobile carrier’s standard rates and fees, such as text messaging and data charges, may apply. These fees are your responsibility, and Pouch Health is not liable for any additional costs incurred while using the app on your mobile device.

19. Third-Party Services and Links

19.1. The Pouch Health app may provide access to third-party websites, apps, or services ("Third-Party Services"). These include but are not limited to healthcare consultations and services provided by the LPC (LPC) and other third-party providers. While Pouch Health integrates these services for your convenience, we do not control these third-party services and are not responsible for their privacy practices, content, or terms of use.

19.2. Pouch Health does not sell your personal data. However, we may process your data through third-party apps or services to enhance your experience. For example, if you book services through the LPC, you may need to give us permission to share your data with the LPC or other healthcare providers to manage your bookings and facilitate your care. You can review how we process your data in conjunction with LPC’s policy, which governs how they handle your personal information.

19.3. The inclusion of links or access to Third-Party Services within the app does not imply endorsement by Pouch Health, and you are solely responsible for evaluating and understanding the terms, privacy policies, and security measures of such services before using them. We encourage you to review their policies to understand how they collect and process your data.

19.4. You agree that you will not link to or associate the Pouch Health app, website, or content with any services or websites in a manner that:

  • Is illegal;
  • Suggests any form of association, approval, or endorsement by Pouch Health where none exists;
  • Damages our reputation or takes advantage of it; or
  • Is unfair or deceptive in any manner.

19.5. Pouch Health disclaims any responsibility for the products, services, or information contained on any linked Third-Party Services, and you use them at your own risk. You are responsible for protecting your personal information and ensuring compliance with the terms of use for any third-party service you access.

20. Your Feedback

20.1. We welcome your feedback about the Pouch Health app. Unless you specifically indicate otherwise, any feedback or communications you submit to us (via email, app stores, or otherwise) are considered non-confidential.

20.2. You agree that we may use, publish, modify, or distribute such feedback at our discretion, without compensation to you. You authorise Pouch Health to make use of your feedback to improve our services or for promotional purposes. We may revise, modify, adjust, or change it in any way we deem appropriate.

21. Enforcement Rights

21.1. Pouch Health is not obligated to monitor all access or use of the App. However, we reserve the right to monitor usage to:

  • Ensure compliance with these Terms and Conditions;
  • Maintain the App’s functionality and performance;
  • Comply with applicable legal requirements.

21.2. We may disclose illegal or unlawful activity to law enforcement agencies as required, and cooperate with authorities to prosecute users who violate the law.

21.3. Pouch Health reserves the right to remove or disable any content posted on the App or restrict access to the App without notice, at our sole discretion, if we determine that your content or behaviour is in violation of these terms.

21.4. We also reserve the right to refuse service, close accounts, or modify eligibility requirements without prior notice or liability. Pouch Health is not liable for any actions or decisions taken regarding the enforcement of these Terms and Conditions.

22. Maintenance and Updates

22.1. From time to time, it may become necessary to change, update, or improve the Pouch Health app to ensure proper functionality and enhance the user experience. This may include updates, patches, or improvements to existing features, as well as the discontinuation of specific services or functionalities.
